1. Acceptance of Terms
By creating an account, bidding, listing, or consigning on YYYUUUPPP ("YYYUUUPPP," "we," "us," or "our"), you agree to be bound by these Terms of Use and any policies referenced herein. If you do not agree, do not use the platform. These terms form a binding contract between you and YYYUUUPPP.
2. Eligibility & Accounts
You must be at least 18 years old and legally able to enter contracts. You must provide accurate, current information and maintain the security of your account credentials. You are responsible for all activity under your account.
3. Verification
All users must complete identity verification before transacting. Auctioneers must submit valid licensing/credential documentation, which YYYUUUPPP reviews before granting selling privileges. Bidders must complete a one-time payment-method verification (a $0.50 authorization that is credited toward your first winning purchase) before placing bids. YYYUUUPPP may reject or revoke verification at its discretion.
4. Roles
YYYUUUPPP supports three roles: Buyers (verified to bid), Sellers (verified to list items), and Auctioneers (verified auction houses that may also request consignment rights). You may update your role through verification. Sellers and auctioneers are responsible for the accuracy and legality of their listings.
5. Listings, Selling & the 1% Fee
Sellers set the starting bid, optional reserve price, optional buy-now price, bid increment, and duration. Listings must accurately describe the item, its condition, provenance, and title status. On a successful sale, YYYUUUPPP retains a flat 1% marketplace fee on the final sale price; the remainder is paid to the seller. There is no buyer premium charged by YYYUUUPPP.
6. Bidding & Binding Bids
Bids are binding offers to purchase. Once placed, a bid cannot be retracted. The highest bid at auction close that meets any reserve wins. A bid at or above the buy-now price wins immediately. Bidding on your own item (shill bidding) is prohibited.
7. Payment
Winners must complete payment through YYYUUUPPP's secure payment processor (Base44 Payments) after the auction closes. Your $0.50 verification credit is automatically applied to your first winning purchase. Customer billing details are collected securely on the payment page; YYYUUUPPP does not store full card numbers.
8. Consignment
Sellers may grant exclusive consignment rights to a verified auction house, which then manages the sale. Consignment terms (including any house commission) are agreed between the seller and the auction house; YYYUUUPPP's 1% marketplace fee still applies to the final sale.
9. Prohibited Conduct
You may not: bid on your own listings; place bids you cannot honor; list counterfeit, stolen, or illegal items; manipulate bids or feedback; harass other users; or circumvent YYYUUUPPP fees. You must comply with all applicable laws, including those governing regulated categories such as firearms.
10. Enforcement & Suspension
To protect marketplace integrity, YYYUUUPPP enforces these Terms automatically and through admin review. A winning bidder who fails to pay within 72 hours of auction close is automatically suspended and the auction is closed for review. YYYUUUPPP may suspend or terminate any account for cause — including non-payment, fraudulent listings, shill bidding, or other breaches — at its discretion. Suspended users cannot bid or list. Suspensions may be appealed by contacting support; reinstatement is at YYYUUUPPP's discretion.
11. Dispute Resolution
Parties will first attempt to resolve disputes in good faith. Unresolved disputes will be resolved through binding arbitration, with class-action waivers, except where prohibited by law.
12. Limitation of Liability
YYYUUUPPP is a marketplace and is not the seller or buyer of listed items. We are not liable for the acts or omissions of users, the condition or authenticity of items, or uncompleted transactions. To the maximum extent permitted by law, YYYUUUPPP's liability is limited to the fees you paid to us in connection with the transaction giving rise to the claim.
13. Modifications
YYYUUUPPP may update these Terms from time to time. Continued use after changes are posted constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which YYYUUUPPP operates, without regard to conflict-of-law principles.
